ODNAP, LLC d/b/a ValuIQ | Effective upon acceptance

This Privacy Policy and Data Agreement describes how ODNAP, LLC, a Tennessee limited liability company doing business as ValuIQ collects, uses, stores, and protects information submitted through the ValuIQ platform. By using the Platform, you agree to the practices described in this Policy.

1. Information We Collect

1.1 Personal Information

We collect personal information you provide directly when creating an account or using the Platform, including: full name and contact information (email address, phone number, mailing address), business name, role, and professional credentials, billing information (processed through third-party payment processors; we do not store full payment card numbers), and login credentials.

1.2 Business and Financial Information

To provide Platform functionality, we collect information about your business, which may include: business financial data (revenue, expenses, profitability, debt, assets), business operational data (processes, staffing, systems, customer data metrics), ownership structure and transaction history, and business valuation inputs and self-assessments.

1.3 Usage and Technical Data

We automatically collect certain technical information when you use the Platform, including: IP address, browser type, and device information, pages visited, features used, and session duration, and log data and error reports.

1.4 MT Subscriber and Tenant Client Data

MT Subscribers who onboard Tenant Clients are responsible for ensuring Tenant Clients consent to data collection under this Policy.

2. How We Use Your Information

We use the information we collect to: provide, operate, and improve the Platform and its features; generate Platform Outputs including readiness scores, assessments, and reports; process payments and manage Subscription accounts; communicate with you regarding your account, updates, and support; develop aggregated, anonymized industry benchmarks; comply with legal obligations; and detect, investigate, and prevent fraudulent or unauthorized activity.

3. How We Share Your Information

3.1 We Do Not Sell Your Data

Company does not sell, rent, or trade your personal or business information to third parties for their marketing purposes.

3.2 Service Providers

We may share information with third-party service providers who assist in operating the Platform. These providers are contractually obligated to use your data only to provide services to us.

3.3 MT Subscriber Access

MT Subscribers can access the Platform data submitted by their Tenant Clients within their configured multi-tenant account.

3.4 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal process.

3.5 Business Transfers

In the event of a merger, acquisition, or sale of substantially all assets, your information may be transferred to the acquiring entity.

4. Data Retention

We retain your information for as long as your account is active. Following termination, we retain data for three years for legal and business record purposes, after which it will be deleted or anonymized.

5. Data Security

We implement commercially reasonable technical and organizational measures to protect your information. These include encrypted data transmission, access controls, and regular security reviews.

6. Your Rights and Choices

Depending on your location, you may have the right to: access the personal information we hold about you; request correction of inaccurate information; request deletion of your personal information; object to or restrict certain processing; and receive a copy of your data in a portable format. Contact us to exercise these rights. We will respond within thirty days.

7. California Privacy Rights

California residents may have additional rights under the CCPA, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of sale (we do not sell personal information).

8. Cookies and Tracking

The Platform uses cookies and similar tracking technologies to maintain sessions, remember preferences, and analyze usage. You may disable cookies through your browser settings.
